Two charged in High Court over ADF links

KAMPALA — The International Crimes Division of the High Court has confirmed terrorism-related charges against two suspects and directed prosecutors to amend the indictment to include additional offences against three others accused of links to the Allied Democratic Forces (ADF).

The ruling, delivered on July 31, 2026, by Justice Susan Okalany, confirmed charges of contributing to acts of terrorism against Swalleh Abubaker and Sulaiman Nsubuga, according to the Office of the Director of Public Prosecutions (ODPP).

The court also ordered the prosecution to add terrorism-related and firearms offences against Giry Girmaley Batange, Kalanzi Augustine and Mubiru Anthony before the matter proceeds to trial.

According to the ODPP, the court found substantial grounds to believe that Abubaker financed terrorism, provided resources to the ADF and belonged to the organisation.

The ruling relied on evidence including forensic reports, cryptocurrency analysis, Binance Know Your Customer (KYC) records, access logs, call data and financial records.

The prosecution alleged that the evidence linked Abubaker to receiving, distributing and transferring funds to known ADF operatives, including convicted operative Kiyemba Arafat, through cryptocurrency and mobile money transactions.

The court therefore confirmed all charges against him.

In the case of Nsubuga, Justice Okalany ruled that there was sufficient evidence for him to stand trial on the alternative charge of contributing resources to a terrorist organisation and the charge of belonging to the ADF.

The court considered evidence including his statements, his association with Abubaker and financial transactions involving convicted ADF operative Meddie Nkalubo.

The ODPP said the court also found evidence showing that funds from a Binance account attributed to Abubaker were transferred to Nsubuga on several occasions.

Meanwhile, the court ruled that there were substantial grounds to believe that Batange, Kalanzi and Mubiru were involved in unlawful activities, including receiving funds suspected to be connected to terrorism and offences related to firearms.

The prosecution has been directed to amend the indictment to include charges of contributing to acts of terrorism as well as offences under the Firearms Act relating to the unlawful possession and importation of firearms and ammunition.

“The Trial Court will thereafter try the accused persons following this decision of the Pre-Trial Court,” the ODPP said in a statement.

The case was handled on behalf of the prosecution by Mr. Jatiko Thomas, an Assistant Director of Public Prosecutions.

The confirmation of charges allows the matter to proceed to full trial, where prosecutors will be required to prove the allegations against the accused beyond reasonable doubt.
