KAMPALA, Uganda — Chief Magistrate Sarah Basemera has committed opposition leader and lawyer Erias Lukwago to the High Court for trial on charges of misprision of treason, with his defence team raising concerns over his deteriorating health condition and seeking his release on bail for specialised medical treatment.
Lukwago was committed to the High Court after prosecution alleged that he had knowledge of a plot involving opposition figures Dr. Kizza Besigye and Hajji Obeid Lutale to overthrow the government but failed to report the alleged plans to authorities.
The charges relate to allegations that the offence occurred between 2021 and November 2024.
During the court proceedings, Lukwago told court that he was prepared to face trial but questioned whether his health condition would allow him to effectively participate in the legal process.
“I’m ready for a complete trial, but when I’m alive. I’m ready to stand trial. I’m ready to defend myself. But how am I kept alive?” Lukwago said.
Defence Seeks Bail and Medical Treatment
Lukwago’s lawyers asked court to grant him bail and allow him to travel to India for specialised medical treatment related to complications from spinal surgery, hypertension and other health concerns.
The defence argued that his medical condition required urgent attention and that continued detention could worsen his health.
Lawyers also raised concerns about his treatment while in custody, alleging that prison authorities removed a therapeutic pillow he uses for medical reasons after suspecting it could be misused.
However, Chief Magistrate Basemera declined to grant the requested medical relief, stating that the Magistrates Court lacked jurisdiction to issue such orders. The defence can now pursue the application before the High Court.
Lukwago Remanded to Luzira
Following his committal to the High Court, Lukwago was remanded back to Luzira Prison as he awaits further proceedings.
His legal team maintained that his right to proper medical care and a fair trial must be protected.
Counsel Medard Lubega Sseggona criticised the prosecution’s position that the Magistrates Court could not handle applications related to Lukwago’s medical treatment.
“What distinguishes us as professionals is how we apply the law to the facts by using our brains to think,” Sseggona said.
Arrest Raises Political Concerns
Lukwago was arrested from his home on June 15, 2026, in connection with the treason-related allegations.
His arrest has drawn criticism from opposition figures, who have accused government of targeting political opponents, particularly given Lukwago’s role as part of Dr. Kizza Besigye’s legal team in a related treason case.
Supporters have also raised concerns about his health, with opposition activists questioning whether he is physically fit to endure prolonged court proceedings.
Lukwago, however, has maintained that he is ready to face the charges and defend himself in court.
The case now moves to the High Court, where Lukwago will be required to appear for trial proceedings and may renew his applications for bail and specialised medical treatment.
