Gov’t ordered to produce Kivumbi in court

KAMPALA, Uganda — The High Court has given the government seven days to explain the whereabouts of former Butambala County Member of Parliament Muhammad Muwanga Kivumbi after his lawyers filed a petition challenging his reported re-arrest.

The Civil Division of the High Court issued the directive after Kivumbi’s lawyers applied for a writ of habeas corpus, asking authorities to produce him before court or provide a lawful explanation for his detention.

The application names the Chief of Defence Forces, Inspector General of Police and Attorney General as respondents. Kivumbi’s lawyers argue that his alleged detention without access to his lawyers and family violates his constitutional rights.

Kivumbi, who is the National Unity Platform (NUP) Deputy President for Buganda, was granted bail on July 9, 2026, by the International Crimes Division of the High Court after spending 169 days on remand.

Justice Susan Okalanyi granted him Shs10 million cash bail and sureties after he faced terrorism-related charges connected to violence reported in Butambala District during the January 2026 election period.

However, his lawyers claim that within 24 hours of his release, he was intercepted by security personnel at a roadblock in Mpigi District while travelling from Butambala. They allege he was taken away in an unmarked security vehicle, and his location has since remained unknown.

The alleged disappearance has raised concern among opposition leaders and rights groups, who have called for transparency from security agencies.

Leader of Opposition Joel Ssenyonyi has questioned the circumstances surrounding Kivumbi’s detention, citing constitutional protections on personal liberty and lawful arrest.

The Uganda Law Society has also expressed concern over reports of unexplained arrests, warning that respect for the rule of law is essential in a constitutional democracy.

Kivumbi has denied the charges against him, while his legal team maintains that his re-arrest after being granted bail was unlawful.

The High Court order now requires state authorities to either present Kivumbi before court or provide reasons explaining his continued detention.

The matter remains under judicial consideration as the court awaits a response from the state.
