High Court Judge Justice Moses Kazibwe has Monday found Brian Bagyenda guilty of the murder of his girlfriend Enid Twijukye.
This is after the court dismissed his insanity defence saying it’s an afterthought to escape justice.
He is the son to Internal Security Organisation [ISO] Director Col Kaka Bagyenda.
Bagyenda, a pharmacist was convicted alongside his accomplices Innocent Bainomugisha, a 24-year-old cleaner, and Vincent Rwahwire, a 28-year-old casual worker.
The judge ruled that Bagyenda increased the volume of the television to prevent people from hearing what was taking place, covered all curtains and sent a maid to go for shopping in Kalerwe which means he had premeditated the murder.
He also dumped the body in an isolated area which actions are not those of an innocent person.
State persecutor Joseph Kyomuhendo asked for a maximum sentence of death to curb the trend of similar murders which are on the rise.
He has been on remand at Luzira prison for the alleged murder of his former Ndejje University girlfriend Twijukye in 2016.
Last month, Bagyenda in his final submissions to this case, asked Justice Kazibwe, to acquit him and instead commit him to safe custody as a criminal lunatic to await a ministerial directive because at the time he is alleged to have committed this offence, he was not mentally upright.
Prosecution’s Joan Keko and Joseph Kyomuhendo asked the court to dismiss Bagyenda’s insanity defence, saying it’s an afterthought lie cooked up to escape punishment.
The Lady Court Assessor Aliana Anastasia who is following the trial on behalf of the public advised Justice Kazibwe to find Bagyenda guilty of murder together with two of his workers Innocent Baimomugisha and Vincent Rwahirwe whom Bagyenda instructed to tie Twijukye on a bed before suffocating her with a pillow, for wanting to leave him.
The alleged offence was committed on January 4th 2017, along Njobe road in Luzira, the home of Bagyenda Brian, before dumping the deceased’ body in Namanve forest along Jinja road.
