The Court of Appeal has cancelled the election of the ruling National Resistance Movement [NRM] Woman MP for Rukungiri district, Winfred Masiko Komuhangi.
Court on Thursday threw Masiko out of parliament and called for a by-election after citing several irregularities in the 2016 election.
Masiko (NRM) was dragged to court by Betty Muzanira of the Forum for Democratic Change (FDC) party, seeking a vote recount or an order for fresh elections alleging there were gross illegalities committed and that Ms Masiko was not validly elected.
Muzanira’s lawyers of Mugalula and Omalla Advocates first filed a petition on April 3, 2016 in Kabale High Court.
Muzanira alleges that cancelled results were included on the final tally sheets; failure to include declared results on the final tally sheets; transportation of polling materials by non-polling officials affiliated to Ms Masiko and that Ms Masiko bribed voters; results announced by Rukungiri district returning officer differed from what was declared in the national gazette.
She also alleges arrest of her agents during the voting period.
The petition claims that a copy of the national gazette shows that Betty Muzanira got 57,812 votes (48.3 per cent) and Winfred Masiko 61,561 votes (51.6 per cent) but on the contrary, the declaration forms signed by Rukungiri district returning officer shows that Masiko got 58,994 votes while Muzanira got 54,966 votes.
According to Ronald Muhinda, Kizza Besigye’s aide, Muzanira, winner of election petition against former Rukungiri Woman MP (accused of stealing votes) Masiko has already arrived at Plot 6 Katonga Road Nakasero.
Together with Kigezi Governor Darius Tweyambe and Martin Byomuhangi, Muzanira is set to meet President Kizza Besigye.
“Rukungiri get ready. President will be in Rukungiri over the weekend. He got information Museveni trespassed in the district recently,” Muhinda said.
