High Court in Kampala has kicked out of office Donna Asiimwe Kusemererwa, the executive director of National Drug Authority (NDA).
Kusemererwa was appointed in January 2016 to head the authority to replace Kate Kikule who served as acting executive director following the sacking of Dr Gordon Sematiko.
Dr Sematiko, Dan Badebye, the head of finance at NDA, were fired in February 2015, for transferring about Shs14b) from the official authority account to an unauthorised fixed deposit account.
After her Kusemererwa took over from Kikule, Florence Nakachwa, the former Head of Drug Assessment and Registration at the authority, filed an application challenging the appointment of Kusemererwa.
According to Nakachwa, the appointment was inconsistent with Section 54(2) of the NDA Act. She concluded that Kusemererwa was illegally occupying the office.
In his Tuesday ruling, Justice Stephen Musota of the Civil Division of the High Court, said the appointment was unlawful and unjustifiable.
“A declaration that the position of the executive director in which the 2nd respondent [Ms Kusemererwa] was appointed was/is non-existent and contrary to Section 54 (2) of the National Drug Authority Act Cap 206,” the judge said.
He directed the Authority to advertise the vacant position of secretary within 60 days from the day of the ruling.
